Terms and Conditions

These Terms of Service (“Terms”) govern your access to and use of TacticalPontoon.com (the “Site”), including purchases made through the Site and related services provided by TacticalPontoon (“TacticalPontoon,” “we,” “us,” or “our”).

By accessing the Site, creating an account, placing an order, submitting content, or otherwise using our services, you agree to these Terms and to the policies incorporated into them by reference.

If you do not agree to these Terms, do not use the Site or purchase products through it.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to make a purchase through this Site.

Because TacticalPontoon sells firearm-related components and accessories, you are also responsible for determining whether you may lawfully purchase, receive, possess, install, transport, and use a particular product in your jurisdiction.

Placing an order represents that your purchase and intended possession and use of the product comply with all applicable federal, state, and local laws.

TacticalPontoon reserves the right to refuse, cancel, or restrict any order when we believe the transaction may violate law, regulation, shipping requirements, payment-provider requirements, or TacticalPontoon policy.

2. Firearm Components and Customer Responsibility

TacticalPontoon manufactures and sells precision firearm components, including components that affect the fire-control system of a firearm.

Modification of a firearm's fire-control system can materially affect its operation and safety.

TacticalPontoon trigger systems and fire-control components should be installed, adjusted, inspected, and tested by a competent and knowledgeable gunsmith or armorer.

The purchaser and installer are responsible for:

• confirming that the product is compatible with the firearm and other installed components;
• performing proper installation and adjustment;
• verifying proper striker-to-trigger-bar engagement where applicable;
• verifying that all factory safety mechanisms remain functional;
• performing complete function and safety checks before the firearm is loaded or fired; and
• periodically repeating appropriate inspections and safety checks as components wear or the firearm is modified.

If any safety check fails, if the firearm fails to reset properly, or if any unintended discharge or multiple-discharge condition occurs, stop using the firearm immediately and have it inspected and corrected by a qualified person before further use.

Additional installation, inspection, maintenance, troubleshooting, and safety information is available through the TacticalPontoon Technical Library and Safety Check & Instructions materials on the Site. Those instructions are incorporated into these Terms by reference.

3. Compatibility, Tolerances, and Modification

Firearms and firearm components are manufactured within dimensional tolerances. Aftermarket frames, slides, strikers, connectors, springs, trigger bars, coatings, stippling, and other modifications may introduce additional dimensional or functional variation.

As a result, a component that functions correctly in one firearm may require additional inspection, fitting, adjustment, or tuning in another firearm of the same general model.

Unless a specific product description expressly states otherwise, the term “drop-in” does not eliminate the purchaser's responsibility to verify compatibility, function, and safety after installation.

Changing components after a TacticalPontoon system has been configured—including the frame, slide, striker, connector, springs, trigger housing, or other fire-control components—may change the performance or safety characteristics of the system and requires renewed inspection and safety testing.

TacticalPontoon is not responsible for malfunctions caused by incompatible components, incorrect installation, improper adjustment, unauthorized modification, improper maintenance, damage, abnormal wear, misuse, or failure to perform appropriate safety checks, except to the extent responsibility cannot legally be excluded.

4. Intended Use

Products must be used only for lawful purposes and in accordance with their product-specific intended use.

Competition-oriented products may have different performance characteristics from products designed for defensive, duty, or general-purpose use. Customers should rely on the intended-use description provided for the specific TacticalPontoon system rather than assuming every product is appropriate for every application.

TacticalPontoon products are not designed or sold for the purpose of unlawfully converting a firearm to automatic fire or creating unlawful firing characteristics.

Any unintended multiple-discharge condition is a malfunction and must be corrected before the firearm is used again.

Do not ship a complete firearm to TacticalPontoon

5. Product Specifications and Performance

TacticalPontoon makes reasonable efforts to provide accurate descriptions, photographs, compatibility information, measurements, trigger-pull weights, reset characteristics, and other performance information.

However, firearm and component tolerances mean that actual performance can vary from one firearm to another.

Unless expressly identified as a guaranteed specification in writing, published trigger-pull weights, travel measurements, reset measurements, photographs, performance descriptions, and similar figures are representative targets or estimates rather than guarantees that every firearm will produce an identical result.

Product appearance may also vary slightly because of coating, polishing, machining, lighting, photography, material variation, and the hand-finished nature of certain products.

6. Built-to-Order and Small-Batch Products

Many TacticalPontoon products are built, tuned, finished, or configured after an order is placed.

Lead times displayed on product pages represent good-faith estimates based on workload, component availability, supplier availability, and the amount of individual work required for the product.

A stated lead time is not a guaranteed delivery date unless TacticalPontoon expressly agrees to a guaranteed date in writing.

Component shortages, supplier delays, quality-control issues, unusually high order volume, required rework, carrier delays, or other circumstances may extend a lead time.

TacticalPontoon would rather delay a product than knowingly send a system that does not meet our standards.

Any cancellation or modification of a built-to-order product is governed by our current Refunds & Returns Policy.

Nothing in this section limits any shipping or cancellation rights that cannot legally be waived.

7. Orders and Order Acceptance

Submission of an order does not guarantee acceptance.

We reserve the right to:

• accept or reject an order;
• limit quantities;
• discontinue a product;
• correct pricing or description errors;
• request additional information;
• cancel orders involving suspected fraud or unauthorized payment;
• cancel an order that cannot legally or practically be shipped to its destination; or
• cancel an order when necessary because required components become unavailable.

If we cancel an order after payment has been collected and no other amount is properly owed under an applicable cancellation or custom-order policy, the appropriate amount will be refunded.

8. Pricing, Payment, and Taxes

Prices may change without notice.

You agree to pay the price, shipping charges, taxes, and other charges displayed and accepted during checkout.

By submitting a payment method, you represent that you are authorized to use that payment method and authorize TacticalPontoon and its payment processors to charge the amounts associated with your order.

TacticalPontoon may suspend or cancel an order if payment cannot be verified or completed.

Applicable sales taxes will be collected when required.

9. Shipping and Restricted Jurisdictions

TacticalPontoon currently ships within the United States unless otherwise expressly stated.

The customer is responsible for providing an accurate shipping address and for ensuring that the ordered products may lawfully be received at the destination.

Some jurisdictions may require TacticalPontoon products to be shipped to a Federal Firearms Licensee (“FFL”) or other authorized recipient as a matter of law or TacticalPontoon compliance policy.

When an FFL or other intermediary is required, the customer is responsible for:

• selecting an eligible recipient;
• confirming that the recipient is willing to accept the shipment;
• providing accurate recipient information;
• completing any paperwork required by the recipient or applicable law; and
• paying fees charged by the recipient.

TacticalPontoon is not responsible for delays, rejection, or additional expenses caused by a customer's failure to coordinate with the selected FFL or other recipient.

Orders that are rejected, refused, undeliverable, or returned because of customer error or recipient refusal may be subject to return shipping charges, restocking charges, cancellation charges, or other amounts permitted by our applicable policies and law.

10. Returns, Refunds, and Cancellations

Returns, refunds, exchanges, and order cancellations are governed by the current TacticalPontoon Refunds & Returns Policy, which is incorporated into these Terms by reference.

Certain built-to-order, personalized, serialized, limited-edition, installed, modified, or used products may be subject to additional return restrictions where permitted by law.

Shipping charges and restocking or cancellation fees may apply as described in the Refunds & Returns Policy.

Nothing in these Terms or our return policies eliminates rights or remedies that applicable consumer law does not permit us to waive.

11. Warranty and Product Service

Any express written warranty provided by TacticalPontoon for a particular product is governed by the terms of that warranty and applicable law.

These Terms do not eliminate or modify any express written warranty or any statutory warranty rights that cannot legally be waived.

Products manufactured by third parties may also be subject to warranties offered by their respective manufacturers.

Legacy Stewardship

TacticalPontoon's Legacy Stewardship program is a voluntary inspection, evaluation, tuning, and support program.

Legacy Stewardship is not a lifetime warranty, warranty extension, service contract, or guarantee of free replacement.

Eligibility, services performed, replacement-part charges, shipping costs, and acceptance of a submission remain subject to the current terms of the Legacy Stewardship program and TacticalPontoon's evaluation of the product.

12. Limited Editions, Serialized Products, and Recognition Programs

TacticalPontoon may periodically offer limited-production, members-only, serialized, special-edition, or individually configured products.

Availability may be limited by quantity, eligibility, account status, or other criteria announced for a particular release.

TacticalPontoon does not guarantee the future resale value, collectibility, rarity, market value, or appreciation of any limited or serialized product.

TacticalPontoon may also operate recognition or community programs, including the TacticalPontoon Legacy Program.

Unless expressly stated otherwise, participation, recognition, cards, classifications, access, invitations, or other benefits associated with these programs:

• have no cash value;
• are not guaranteed based solely upon purchase volume;
• do not create a contractual entitlement to future products or benefits; and
• may be modified, discontinued, expanded, restricted, or administered by TacticalPontoon at its discretion.

13. Accounts and Members-Only Access

Some areas of the Site may require an account or specific account permissions.

You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

You agree to provide accurate account information and to update that information when necessary.

You may not transfer, sell, share, or misuse restricted Site access.

TacticalPontoon may suspend or terminate an account or members-only access for fraud, abuse, violation of these Terms, misuse of restricted content, attempted circumvention of access controls, or other conduct that threatens TacticalPontoon, the Site, or its users.

14. Reviews, Photographs, and User Content

The Site may allow customers to submit reviews, photographs, comments, build information, or other content (“User Content”).

You retain ownership of User Content you create.

By voluntarily submitting User Content to TacticalPontoon or posting it through features intended for public display, you grant TacticalPontoon a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, distribute, resize, format, and share that content for operating, promoting, or documenting TacticalPontoon and its products.

You represent that you have the right to submit the content and that its use will not infringe another person's copyright, trademark, privacy, publicity, or other rights.

We may remove User Content that is unlawful, fraudulent, threatening, abusive, infringing, misleading, malicious, unrelated, or otherwise inappropriate for the Site.

Submission of a review does not guarantee publication.

TacticalPontoon does not require a customer review to be positive.

15. Intellectual Property

The Site and its original content—including TacticalPontoon product names, photographs, graphics, written material, designs, logos, videos, technical content, and other proprietary material—are owned by or licensed to TacticalPontoon and are protected by applicable intellectual-property laws.

Except for ordinary personal use of the Site, you may not reproduce, republish, commercially exploit, scrape, systematically collect, modify, distribute, or use TacticalPontoon Site Content without permission.

You may not use TacticalPontoon trademarks, logos, photographs, product descriptions, or other proprietary materials in a manner that falsely suggests sponsorship, endorsement, affiliation, or authorization.

Automated scraping, data harvesting, or systematic extraction of Site Content for commercial databases, machine-learning datasets, competing product catalogs, or similar commercial purposes is prohibited except where such restriction is prohibited by law.

16. Prohibited Use of the Site

You may not use the Site to:

• violate applicable law;
• commit or facilitate fraud;
• gain unauthorized access to accounts or systems;
• introduce malware or malicious code;
• interfere with Site operation;
• impersonate another person or business;
• create accounts using materially false information;
• harvest personal information about other users;
• circumvent members-only or other access restrictions; or
• infringe the intellectual-property or privacy rights of another person.

17. Electronic Communications

When you place an order, create an account, submit a request, or otherwise transact with TacticalPontoon electronically, you consent to receiving transactional communications electronically when legally permitted.

Transactional communications may include order confirmations, shipping notices, account notices, service communications, and policy notices.

Marketing communications are subject to applicable law and any available subscription or opt-out preferences.

18. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

19. Third-Party Services and Links

The Site may contain links to, integrations with, or services provided by third parties, including payment processors, shipping carriers, social-media platforms, and other websites.

TacticalPontoon does not control third-party websites or services and is not responsible for their content, availability, privacy practices, security, policies, or actions.

Use of a third-party service may be subject to that provider's own terms.

20. Website Disclaimer

The Site and Site Content are provided on an “AS IS” and “AS AVAILABLE” basis to the fullest extent permitted by law.

TacticalPontoon does not guarantee that the Site will always be uninterrupted, error-free, secure, or free from harmful components, or that every description, photograph, availability indicator, or other piece of Site Content will always be completely current or free from error.

This Site disclaimer is separate from any product warranty rights that may apply to a TacticalPontoon product.

21. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TACTICALPONTOON AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SITE, THESE TERMS, OR A TRANSACTION THROUGH THE SITE.

TO THE FULLEST EXTENT PERMITTED BY LAW, TACTICALPONTOON'S AGGREGATE LIABILITY ARISING FROM A PARTICULAR PURCHASE OR TRANSACTION WILL NOT EXCEED THE AMOUNT PAID TO TACTICALPONTOON FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

These limitations do not apply where liability cannot legally be excluded or limited, including rights or liabilities that applicable product-liability, consumer-protection, warranty, personal-injury, fraud, gross-negligence, or other law makes nonwaivable.

22. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless TacticalPontoon and its owners, employees, contractors, agents, and service providers from third-party claims, damages, liabilities, costs, and reasonable legal expenses arising from:

• your unlawful use of the Site;
• your violation of these Terms;
• your infringement of another person's rights;
• your unlawful purchase, possession, transfer, or use of a product;
• materially improper installation or modification performed by you;
• knowingly using a firearm after a failed safety check or known malfunction; or
• User Content submitted by you.

This provision does not require you to indemnify TacticalPontoon for liability that applicable law prohibits TacticalPontoon from transferring or disclaiming.

23. Termination

TacticalPontoon may suspend or terminate access to the Site or an account when reasonably necessary because of a violation of these Terms, fraudulent activity, security concerns, abuse, unlawful conduct, or misuse of restricted Site features.

Provisions that by their nature should survive termination—including intellectual-property provisions, limitations of liability, indemnification, and dispute-related provisions—will survive termination to the extent permitted by law.

24. Governing Law

These Terms and transactions with TacticalPontoon are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles, except where the law of another jurisdiction must apply and cannot legally be waived.

Any dispute not subject to another valid written dispute-resolution agreement shall be brought in a court of competent jurisdiction serving TacticalPontoon's principal place of business, unless applicable law gives the consumer a nonwaivable right to bring the matter elsewhere.

25. Changes to These Terms

We may update these Terms periodically to reflect changes in our products, services, policies, technology, or legal obligations.

The revised Terms will become effective when posted with an updated “Last Updated” date unless another effective date is stated.

Changes will not retroactively alter rights or obligations where doing so would be prohibited by law.

26. Severability and Waiver

If a provision of these Terms is found unenforceable, that provision will be limited or removed only to the extent necessary, and the remaining provisions will remain in effect.

Failure by TacticalPontoon to enforce a provision on one occasion does not waive the right to enforce it later.

27. Assignment

You may not assign your rights or obligations under these Terms without TacticalPontoon's written consent.

TacticalPontoon may assign these Terms in connection with a merger, sale, reorganization, transfer of the business, or similar transaction, subject to applicable law.

28. Entire Agreement

These Terms, together with applicable product descriptions and the policies incorporated by reference—including the Privacy Policy, Refunds & Returns Policy, Shipping Policy, applicable shipping FAQs, Technical Library/Safety Check & Instructions, and any applicable written warranty—constitute the agreement governing use of the Site and purchases made through it.

If a specific written product term directly conflicts with a general provision of these Terms, the more specific product term will control for that particular product or transaction to the extent permitted by law.
